Probation Guide
Probation Services in California: Supervision, Reports and Court-Ordered Conditions
Probation is more than serving a sentence outside jail. Depending on the case, a person may still have custody, treatment, monitoring or other requirements. The court sets the legal order, and the probation department carries out its assigned role.
Quick answer
What Do California Probation Departments Do?
- Before sentencing, probation may prepare a presentence investigation or report where required.
- After sentencing, probation may supervise, monitor conditions, make referrals and report alleged violations.
- The court sets the legal order. Probation recommendations do not bind the judge.
- Conditions vary by case. No one list applies to everyone.
Two functions
Probation Can Have Different Functions
Two lanes: before sentencing (presentence report) and after sentencing (supervision, monitoring, referrals, reporting).
Before sentencing
- Presentence investigation or report
- Where required
The court sets the legal order.Probation administers its assigned role.
After sentencing
- Supervision
- Monitoring of conditions
- Referrals and services
- Reporting alleged violations
Before sentencing
The Presentence Report
Under Rule 4.411 and Rule 4.411.5, probation may prepare information, an evaluation and recommendations where legally applicable. The probation officer does not decide the sentence, and the recommendation does not bind the judge.
Conditions
Possible Probation Conditions
Conditions may include reporting, drug testing, alcohol testing, treatment, community service, restitution, monitoring, restrictions and other lawful conditions. Not every case has every condition. Rule 4.414 lists criteria affecting probation. See Court-Ordered Drug Testing and Treatment Plan for Court.
Violations
Alleged Violations
Rule 4.435 addresses sentencing after probation is revoked. One violation does not automatically revoke probation, every violation does not mean jail, and a missed appointment does not automatically cause a warrant. Counsel handles any alleged violation; the court decides.
Records
Progress Records
Accurate provider records may help counsel understand compliance. See Court Progress Report and Probation Monitoring.
Legal note
Probation terms, modifications and revocation are court decisions. Counsel handles probation issues.
