Pretrial Diversion in Florida
Florida has several diversion paths. Most are run by the State Attorney's Office in each judicial circuit or by the courts. ETS helps clients through the treatment and testing steps and keeps clear progress records.
Programs that may apply
Diversion Options Used in Florida
Florida programs and requirements differ by circuit. Your attorney can explain which options apply to your case.
Pretrial intervention (PTI)
Authorized under Fla. Stat. § 948.08. Eligibility depends on the charge, prior record and the consent of the state attorney and others the statute names.
Drug court and substance-related diversion
Some drug-related charges may be eligible for treatment-based programs under Florida law and local court rules.
Mental health and veterans courts
Many circuits run mental health courts and veterans treatment courts for eligible people.
Misdemeanor diversion
Many circuits offer misdemeanor diversion through the State Attorney's Office, with local terms.
How it usually works
How Diversion Support Works in Florida
Every case is different. This is the general order of steps when ETS is involved.
- 01
Attorney review
Your attorney reviews the charges and decides whether diversion or mitigation is worth pursuing.
- 02
Evaluation and plan
If treatment-related support makes sense, ETS helps arrange appropriate evaluations and a service plan.
- 03
Participation
You attend treatment, classes or testing. ETS tracks attendance and results.
- 04
Documentation
ETS prepares organized progress records your attorney can review and share when appropriate.
- 05
Court decision
The court, and in some programs the prosecutor, decides whether diversion is granted and how the case ends.
