California Background Check Guide

Does Pretrial Diversion Show Up on a Background Check in California?

There is no single background-check database. Whether a diversion case appears can depend on who is checking, which records they are legally allowed to access, the case disposition and whether automatic or petition-based record relief has been applied.

Quick answer

Can Pretrial Diversion Appear on a Background Check?

  1. Potentially. It depends on the record source, case stage, dismissal and any record relief.
  2. It also depends on the type of background check and the requester's legal authority.
  3. There is no universal yes or no answer.

Types of checks

"Background Check" Can Mean Different Things

Four types of background checks: public or court record search, California DOJ fingerprint check, commercial background check and criminal justice or government access.

Public / court record search

  • Uses available court or public record information

California DOJ fingerprint check

  • DOJ releases only information authorized by California law for the specific applicant purpose

Commercial background check

  • May gather permitted information from court / public / other lawful sources

Criminal justice / government access

  • Different legal access rules may apply

Court

Court Records

Court records are separate from DOJ records. When a California court receives notice of qualifying automatic relief, public access can be restricted as provided by law. That does not mean every commercial database updates instantly.

California DOJ

California DOJ Fingerprint Checks

The California DOJ maintains state summary criminal-history information. Fingerprint-based applicant responses are governed by California law. Automatic relief under PC §851.93 and PC §1203.425 changes dissemination as provided by law; it does not delete the record.

Private companies

Commercial Background Checks

The California DOJ explains that commercial background-check providers are not the DOJ and do not directly access DOJ criminal-history records simply because they provide background checks. They may obtain information from other lawful sources.

Case outcome

What Changes After Dismissal?

Dismissal changes the case outcome. It does not by itself remove the case from every record system. See charges dropped vs dismissed.

Record relief

What Changes After Record Relief?

Automatic or petition-based relief can limit how records are disclosed, as provided by law. For how those mechanisms work after diversion, see SB 731 and diversion records. For conviction relief, see the California Clean Slate Act guide.

Sealed records

Can Government Agencies Still See a Sealed Record?

California Courts says records sealed under applicable arrest-sealing procedures are no longer publicly available, while certain government agencies may retain access. Disclosure requirements can remain in specific circumstances.

Employment

If a Record Appears, Does That Mean an Employer Can Use It?

Not necessarily. What a record system contains and what an employer may lawfully ask about or consider are separate questions. Employment rules depend on the position, the type of employer, background-check authority and applicable state and federal law. Ask qualified employment counsel about your situation.

Duration

How Long Does the Record Remain?

There is no universal duration. See how long diversion stays on your record.

Legal note

Licensing, employment and immigration questions need qualified legal advice.
