Custody Monitoring Guide
Alcohol Monitoring in Child Custody Cases: What It Can and Cannot Show
Alcohol monitoring may document certain test results over time. It does not by itself establish parental fitness, a right to custody or the child's best interest. Court-ordered testing and voluntary private monitoring are different.
Quick answer
What Can Alcohol Monitoring Show in a Custody Case?
- Alcohol monitoring may document certain testing results over time.
- It does not by itself establish parental fitness or custody entitlement.
- It does not establish the absence of every substance-use issue or the child's best interest.
- It does not prove the truth or falsity of every allegation.

Court-Ordered Testing Under Family Code §3041.5
Family Code §3041.5 sets a specific framework for court-ordered drug or alcohol testing in custody and visitation cases. The court must first make a threshold finding, the testing must follow the statute's procedural rules, and results have limited, confidential uses. A positive result by itself does not automatically decide custody. Not every private monitoring arrangement is testing ordered under §3041.5.
Voluntary
Voluntary Private Monitoring Is Different
Private monitoring may provide information. It does not automatically satisfy a court order or receive any specific evidentiary treatment. Counsel should review how it may be used. See Remote Alcohol Monitoring.
Limits
What Monitoring Cannot Show
Monitoring covers what the device or test measures, for the period it runs. It does not show parenting ability or every factor in the court's best-interest analysis.

Monitoring and Treatment Are Different
Monitoring reports test results. Treatment addresses clinical needs. See Voluntary Treatment and Custody and Alcohol Assessment for Court.
Legal note
Whether monitoring results are used, and how, is decided by counsel and the court. Testing providers report results; they do not decide custody.
