HS §11395 Treatment Workflow

HS §11395 Treatment: How the Treatment-Mandated Felony Process Works

The HS §11395 treatment option has two tracks running side by side: a legal track handled by counsel and the court, and a clinical track handled by qualified providers. This guide explains how they fit together and what treatment planning may involve.

HS §11395Treatment Process

Quick answer

How Does the Process Work?

  1. If §11395 applies, the person reviews options with counsel.
  2. The treatment option follows a guilty or no contest plea under deferred entry of judgment.
  3. Qualified providers handle assessment, placement and level of care.
  4. Clinical treatment does not replace legal requirements.

Qualified providers

The Clinical Path

Qualified providers assess needs, recommend a level of care and provide treatment. Their recommendations are clinical, not legal.

What it may involve

What Treatment Planning May Involve

There is no one universal treatment plan. Depending on the person, planning may include:

  • Assessment
  • Level of care
  • Substance-use treatment
  • Mental-health treatment where relevant
  • Case management
  • Testing
  • Continuity of care

During treatment

Progress and Program Recommendations

Programs track progress and may provide recommendations. Under §11395, a positive program recommendation may be part of the completion process where required.

Important difference

Treatment Planning Is Not Legal Eligibility

Having a treatment plan does not decide any legal question. Whether §11395 applies and what happens in the case are decided under the law. See Who Can Face §11395?

Completion and Noncompletion

Legal note

Legal requirements come from the statute and the court. Clinical recommendations come from qualified providers. Neither replaces the other.
