Legal Overview
The Intersection of California Criminal Law and Federal Immigration
A California criminal case and federal immigration law are two separate systems. A result in state court does not automatically decide how federal immigration law treats it. If you are not a U.S. citizen, ask a criminal defense attorney and an immigration attorney to work together early.
Quick answer
Can a California Criminal Case Affect Immigration?
- Yes, it can. Federal immigration law may treat some criminal results as having consequences.
- Federal law uses its own definition of "conviction," which can differ from state law.
- Diversion, dismissal or treatment do not automatically prevent immigration consequences.
- Criminal defense counsel and immigration counsel should review the case together.

Key point
State Results Do Not Control Federal Treatment
Federal law defines \"conviction\" for immigration purposes in 8 U.S.C. §1101(a)(48)(A). That definition can include some outcomes that state law treats differently. How a specific result is treated is a question for immigration counsel. See also USCIS Policy Manual guidance.
California law
California Requires Immigration Advice
California requires defense counsel to give accurate advice on immigration consequences under Penal Code §1016.3, and the court must give an advisement before certain pleas under §1016.5. Section 1473.7 may allow some people to challenge a past conviction in limited cases.
Caution
Diversion, Dismissal and Treatment Are Not Shields
Some outcomes may carry less risk than others, but none is a guarantee. Admissions, plea forms and records can matter. Do not assume diversion or dismissal prevents immigration consequences. See Charges Dropped.

Why Two Attorneys Should Coordinate
Criminal defense counsel handles the state case. Immigration counsel advises on federal effects. Working together before any plea or program can help them weigh choices. Share records only when you authorize it.
Legal note
Immigration consequences depend on individual facts and federal law. Only a qualified immigration attorney can advise on your situation.
