House Arrest Rules in California: Where the Rules Come From

There is no single list of house arrest rules in California. Rules depend on the court order, the county program, the equipment and the case. Your own order and program agreement control what you can and cannot do.

Quick answer

What Are the Rules for House Arrest?

  1. Rules come from your court order and the monitoring program's agreement.
  2. Permission for work, school, medical visits or other trips varies by order and program.
  3. Equipment, curfews and zones depend on the program and device used.
  4. What happens after a problem depends on the facts, the agency and the court.

California law

How California Law Treats Home Detention

California has statutes for home detention programs, such as Penal Code §1203.016 for county programs in place of jail and §1203.018 for certain pretrial electronic monitoring. Each program sets its own rules within the law.

Permission

Work, School, Medical Visits and Other Trips

Some orders or programs allow approved trips for work, school, treatment or medical care. Others limit them. Do not assume a trip is allowed. Get permission the way your program requires, in advance when possible.

Monitoring

Equipment, Zones and Schedules

Devices differ. Some track location. Some check alcohol. Programs set charging, schedule and zone rules. See Pretrial Electronic Monitoring and Remote Alcohol Monitoring.

If something goes wrong

What Happens After an Alert or Missed Rule

An alert does not always mean a violation. The agency may review it, and the court decides what follows. Contact your attorney quickly and keep any records that explain what happened.

Legal note

House arrest terms are legal orders. Ask your attorney about your specific rules.
